Terms and Conditions

1. Accepting these terms

By downloading or using the MileBack app or website, you agree to these Terms and our Privacy Policy. If you don't agree, don't use MileBack. You must be at least 18 years old and able to enter a binding contract.

2. The service

MileBack is an iPhone app that detects and records your drives using your device's location and motion sensors, classifies them as business or personal, calculates estimated values using the IRS standard mileage rate, and lets you export mileage reports as PDF or CSV. We may add, change or remove features over time.

3. Not tax, legal or accounting advice

MileBack is a record-keeping tool. We are not a tax preparer, accountant or law firm, and MileBack does not file tax returns. Deduction amounts shown in the app and on our website are estimates for information only. Whether a trip is deductible, and how much tax you save, depends on your circumstances and the law that applies to you. Consult a qualified tax professional before relying on MileBack's figures.

4. Accuracy and your responsibility

Automatic tracking depends on GPS, sensors, network conditions, your device settings and the permissions you grant. As a result, MileBack may occasionally miss a trip, split or merge trips, record an inaccurate distance or address, or classify a trip incorrectly.

• Automatic classification (for example "always working" or working hours) is a default, not a determination that a trip is deductible. You decide the purpose of each trip.
• You are responsible for reviewing your trips and reports for accuracy and completeness before using them for tax, reimbursement or any other purpose.
• You are responsible for keeping copies of your exported reports. Your trip history is stored on your device, and we cannot recover it if your device is lost or the app is deleted.

5. Subscriptions and free trials

• Billing through Apple. MileBack subscriptions are purchased through the Apple App Store and charged to your Apple ID. Apple's terms apply to payment.
• Price. The price, billing period and currency are shown in the App Store before you confirm your purchase.
• Free trial. If a free trial is offered, it lasts for the period shown at purchase (currently 3 days). Unless you cancel at least 24 hours before the trial ends, it converts automatically into a paid subscription and you will be charged. Any unused part of a free trial is forfeited when you buy a subscription.
• Automatic renewal. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Cancelling. Open Settings → [your name] → Subscriptions on your iPhone. Cancelling stops future renewals; you keep access until the end of the period you've paid for. Deleting the app does not cancel your subscription.
• Refunds. Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• Price changes. If we change the price, Apple will notify you in advance as required, and you can cancel before the new price applies.

6. Your licence to use MileBack

We grant you a personal, non-exclusive, non-transferable, revocable licence to use MileBack on Apple devices you own or control, for your own business and personal record-keeping, subject to these Terms and Apple's Usage Rules. MileBack, including its software, design, text and trademarks, belongs to us or our licensors. You may not copy, modify, reverse-engineer, resell or distribute it except as allowed by law.

7. Acceptable use

You agree not to use MileBack to create false or misleading records, to track another person without their knowledge and consent, to break any law, or to interfere with the app or its providers.

8. Your data

Your trip records belong to you. We process personal data as described in our Privacy Policy. You can delete your data at any time — see Delete my data.

9. Third-party services

MileBack relies on services from third parties, including Apple (payments, maps and address lookup) and RevenueCat (subscriptions). We are not responsible for third-party services, and their own terms may apply.

10. Driving safely

MileBack works in the background and never needs your attention while you drive. Do not interact with your phone while driving. Always follow traffic laws.

11. Disclaimers

To the extent permitted by law, MileBack is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the app will be uninterrupted, error-free, or that every trip will be recorded, or that any deduction will be accepted by a tax authority. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.

12. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost tax benefits, penalties, interest, or lost data, arising from your use of MileBack. Our total liability for any claim relating to MileBack is limited to the amount you paid for your MileBack subscription in the 12 months before the claim. These limits do not apply to liability for death or personal injury caused by our negligence, for fraud, or to any other liability that cannot be excluded by law.

13. Ending these terms

You can stop using MileBack at any time by deleting the app and cancelling your subscription. We may suspend or end your access if you seriously breach these Terms. Sections that by their nature should survive (including 3, 4, 11, 12 and 15) continue after these Terms end.

14. Apple-specific terms

If you downloaded MileBack from the Apple App Store, you and we acknowledge that:

• These Terms are between you and us only, not Apple, and we — not Apple — are solely responsible for MileBack and its content.
• Apple has no obligation to provide any maintenance or support for MileBack.
• If MileBack fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for MileBack.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to MileBack, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims MileBack infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law and disputes

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts there. Before bringing a claim, please contact us at info@mileback.app so we can try to resolve it informally.

16. Changes and contact

We may update these Terms. If a change is significant, we'll notify you in the app or on this page before it takes effect; continuing to use MileBack after that means you accept the updated Terms. If any part of these Terms is found unenforceable, the rest remains in effect.
